These Bridgemart Purchase Card Terms and Conditions (“Terms and Conditions”) apply in addition to the Terms of Use set forth in the program sponsor’s Commercial Agreement. For purposes of these Terms and Conditions, including the arbitration provision set forth below, the term “Bridgemart” shall be interpreted broadly to encompass Bridge Purchasing Solutions, Inc, Bridgemart, and any of its predecessors, successors, assigns, parents, subsidiaries, affiliates, and each of their respective officers, directors, shareholders, employees, and agents.
These terms and conditions contain a mandatory arbitration provision that, as further set forth below, requires the use of arbitration on an individual basis to resolve disputes. This means that you and bridgemart are each giving up the right to sue each other in court or in class actions of any kind. In arbitration, there is no judge or jury and there is less discovery and appellate review than in court.
Notwithstanding anything contained in these Terms and Conditions, Bridgemart Purchase Cards may not be redeemed, returned or refundable for cash. They are to be used to purchase the goods and services, and only the goods and services, approved by the program sponsor. Items purchased may not be returned for cash. If an item that was purchased using an Bridgemart Purchase Card is returned, the returned value must be reapplied back to the Bridgemart Purchase Card that was used to make the original purchase. Resale of Bridgemart Purchase Cards is strictly prohibited.
Bridgemart Purchase Cards may be redeemed at any participating Walmart location. In some cases Bridgemart Purchase Cards may also be utilized to purchase authorized “Sold and Shipped by Walmart” products online at Walmart.com. Available network options will be clearly identified on the specific Bridgemart Purchase Card received.
Bridgemart and Walmart are independent business entities. Walmart is an independent network provider for Bridgemart purchase cards. Walmart has no ownership interest in Bridgemart and Bridgemart has no ownership interest in Walmart.
By redeeming an Bridgemart purchase card, you are certifying and representing that the activities in connection with which the Bridgemart purchase card will be used will comply with these Terms and Conditions and all applicable laws, rules and regulations, and that the Bridgemart purchase card will not be used in any manner that is misleading, deceptive, or unlawful. In addition, Bridgemart is not liable for any claims or expenses incurred by card recipient in connection with your use of the Bridgemart purchase card or violation of any of these Terms and Conditions.
Lost or stolen cards that have not been used, may be replaced at the sole discretion of the program sponsor. Bridgemart shall have no liability to you for (i) lost or stolen Bridgemart purchase cards or (ii) use of any Bridgemart purchase cards by third parties through their Walmart.com account. You are solely responsible for keeping the Bridgemart purchase card details safe and protected.
Card recipients may retrieve their card balance by calling 1-888-752-1120. It may take up to 24 hours for purchases made using an Bridgemart purchase card to show up on the account. Consequently, any balance retrieved is an estimate only.
Please read this section carefully. It may significantly affect your legal rights, including your right to file a lawsuit in court. This arbitration provision provides that you and Bridgemart waive any right to file a lawsuit in court or participate in a class action for matters within its terms.
Except for disputes that qualify for small claims court, all disputes arising out of or related to these terms and conditions or any aspect of the relationship between you and bridgemart, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, will be resolved through final and binding arbitration before a neutral, single arbitrator instead of in a court by a judge or jury, and you agree that you and bridgemart are each waiving the right to sue in court and to have a trial by a jury. Dispute shall be interpreted as broadly as permitted under the law and shall cover any claims that arose before these or any prior terms and conditions. You agree that any arbitration will take place on an individual basis; as set forth below.
This arbitration provision shall survive any termination of these Terms and Conditions. Any amendments to this arbitration provision shall not affect any pending asserted claim or arbitration proceeding.
The law applicable to the interpretation and construction of these Terms and Conditions in any arbitration shall be the Federal Arbitration Act, applicable federal laws, and the laws of the State of Texas without regard to principles of conflicts of laws. If any dispute is found not to be arbitrable, then ordinary choice of law rules will apply in any court proceeding in which the matter is adjudicated.
These Bridgemart purchase card Terms and Conditions were last updated on the date set forth above. Bridgemart may update these Terms and Conditions at any time. We recommend that you check these Terms and Conditions periodically for changes.
